Overview
After participating in this course, you will be able to:
- Learn about a large number of early warning signs of claims and disputes.
- Learn what types of claims and disputes may arise from each warning sign if the issue is not resolved promptly.
- Understand what must be done to prevent such follow on claims and avoid disputes.
The webinar identifies which party should watch for which early warning sign and what sort of claim or dispute may arise. The purpose of the webinar is to provide both owners and contractors with a list of early warning signs so that they can be proactive in dealing with such situations and prevent claims and disputes from disrupting the project.
Description
It is axiomatic that claims and disputes on a project do not simply appear out of nowhere. Experience indicates that when a dispute occurs, there is normally a back story or history of events, decisions, lack of decisions, etc. that can be traced back from a few weeks to several years that gave rise to the dispute.
It is these past events or decisions that are later identified as early warning signs of claims and disputes. Typically, it is only when claims are filed at the end of a project that attorneys and claims consultants review project documentation and interview the project team that these early warning signs are identified. And, in retrospect, many project team members comment If only I had recognized that then! Research reveals there is little literature setting forth a detailed list of early warning signs of potential construction claims and disputes.
Based on the collective observations of numerous construction claims consultants these early warning signs have been gathered and collated into the typical phases of a project including:
- Bid or Proposal Phase
- Initial Contract Phase
- Construction Phase
The webinar provides a thorough discussion of many early warning signs of potential claims and disputes that may arise on construction projects. Each warning sign is associated with a particular type of claim or claims and the dispute that may arise if prompt action is not taken.

Instructor
Jim ZackJim is the Senior Advisor to the recently formed Ankura Construction Forum™.
The Forum strives to be the construction industry’s resource for thought leadership and best practices on global avoidance and resolution of construction project disputes. Jim was the founder and Executive Director of the Navigant Construction Forum™. Formerly he was the Executive Director of Corporate Claims Management Group, Fluor Corporation, one of the world’s largest EPCM contractors. Before this, Jim was Vice President of PinnacleOne, Executive Director of the PinnacleOne Institute, and Senior Construction Claims Consultant for CH2M HILL, Inc.
For 46 years, he has worked on private and public projects throughout the U.S. and in 28 countries abroad. Jim has worked for contractors and owners on over 5,000 claims in his career. He is a Fellow of AACE International, the Royal Institution of Chartered Surveyors and the International Guild of Project Controls. He is a recognized and published expert in the mitigation, analysis and resolution of defense of construction claims and disputes in the construction claims field.
Jim is a Certified Construction Manager (CCM), a Certified Forensic Claims Consultant (CFCC), and a Project Management Professional (PMP).
